Is Carly Rousso Getting Preferential Treatment in DUI Death?
An attorney argues that the appearance of favoritism and the apparent hush-hush coverage will probably make no difference in the criminal prosecution of the 18-year-old who drove into a family, killing a 5-year-old, last Monday.
Is Carly Rousso being treated differently in an alleged DUI crash that killed a little girl? Or perhaps a better question is: Will Rousso's apparently privileged upbringing even make a difference?
Jaclyn Santos-Sacramento: The Story So Far
Sure, things seem to be going a little easier so far for Rousso, the 18-year-old daughter of two prominent North Shore residents. Initial reports about the death of 5-year-old Jaclyn Santos-Sacramento indicated only that a car drove up on a sidewalk and struck her, her brothers, and her mother. There was no mention of possible alcohol or drug involvement.
And yes, it did take until Wednesday night, after a lot of complaining by a local Hispanic-community activist and the mayor of Highland Park, to have word of Rousso's misdemeanor drunken-driving charges released to the public.
But will it make a difference?
According to the prosecutor's office, the charges have been in place since Monday, as they were required to obtain Rousso's blood and urine samples. They have no idea why it took so long to release the news to the press. As for the misdemeanor DUI charge, it will stay a misdemeanor until toxicology results return in a couple of weeks.
Despite the appearance of favoritism, and the apparent hush-hush coverage of the alleged DUI, the answer to the question is this: It will probably make no difference whatsoever in Rousso's cirminal prosecution.
If the toxicology results indicate that Carly Rousso was drunk, she'll almost certainly be charged with the same aggravated DUI charges that any other drunk driver would face for running down a child and her family. (Yes, it has happened before.) She'll likely face a lengthy prison sentence of up to 14 years, a license suspension, and public shame and humiliation.
So, can we please calm down with the race and privilege cards, at least for now? The prosecutor is not going to let someone walk just because her parents run some hoity-toity art center in the suburbs. And imagine the coverage the case will get if and when felony charges are brought against a privileged suburban girl gone bad.
So be patient. If Carly Rousso deserves it, she'll likely get what's coming to her. Besides, she's innocent until proven guilty.

I disagree with the author of this piece. The public has a right to wonder why this case has been handled differently from the outset, regardless of what the outcome will be. A five year old child has died, remember.

@Ob64 - Well, there are a couple of differences. The first is Cook County vs. Lake County. The second is that the woman from the Cook County case had a record of driving issues - we have not heard anything similar to date regarding the woman from Highland Park. A third difference is that the woman in the Skokie accident CONFESSED to using drugs that morning and there was a corroborating witness to the drug use as well - there is no confession that I am aware of in the HP case. Baring the confession, they are waiting on the toxicology results.
I know many want to scream "privilege", but all I really see now is the methodical process of government chugging along.

Sorry to burst your comparison bubble, Ob64, but the CBS News article you have linked about Hanin Goma is dated 5/23/12, a Wednesday, discussing her vehicular homicide and arrest that occurred on a Monday, 2 days before. Also, the article notes that she was arrested on a misdemeanor drug charge, like Carly Rousso, but also on a felony DUI. That likely means she blew over .08 for alcohol intoxication, while apparently Carly wasn't drinking, or drinking enough to put her over .08. Carly was arrested immediately after the accident. She must have been required to post bond (possibly in court in Waukegan) and we don't know the amount (unlike the $250K bond for Hanin Goma) because evidently none of Chicagoland's intrepid journalists in the print and electronic media have troubled themselves to find out and report it. Maybe one of the the Patch's reporters will be hit by a lightning bolt of curiosity and find out the amount of Carly Rousso's bond.

@Chilawyer -- She posted a personal recognizance bond according to a copy of the citation that was posted on Patch (but since removed from Patch --- why???).
No drivers license taken, bond card, or anything like that, at least according to the citation. It's strange. The citation also does not show the time the citation was written (only the date), but it does have the time of the incident. So she could have been cited at 11pm, or shortly before they drew blood. But regardless, she had to sign the PR Bond forms to post a PR bond.

I do not like the tone of your article, very very cold, poorly written !! There are the concerned loving people of our community supporting and grieving with Jaclyn Santos-Sacramento's family. There is a mother dealing with the loss of her beautiful child, almost loosing the 2 boys. Imagine !! Then there is Carly, who obviously is in so much pain at such a young age to be that messed up driving her fathers car..something her privileged family has to deal with unfortunatly after this horrific accident... or somehow missed the severity of her pain of her young life...sad all the way around. What is your problem? There author did a LOGICAL evaluation as to why the case wasn't rammed through quickly and Carly tossed in jail. Based on your statements, did you want her convicted already? The article was WELL WRITTEN as it just laid out the FACTS, which is what you want in LEGAL proceedings.

They are under no obligation to VOLUNTEER information; but they must respond to FOIA requests in accordance with the law. They do not have to release information that is confidential regarding a pending investigation (as that could jeopardize the investigation) but identities of arrested persons and the charges against them are not considered confidential. Most newspapers have standing FOIA requests to their local police departments for arrest info; that's how they get the material for their police blotter columns. Under FOIA, government entities have 7 days to respond, but police departments respond much more quickly.

First of all, it's department policy for just about ALL police departments not to release personally identifying information. Even with a subpoena. Toxicology tests take time to come back... Even though somebody died, you can't just assume the person at fault was criminally responsible. Last time I checked, 660 people have died this year on Illinois roads. Certainly, many of those had no criminal charges.
Also, being that its an election year, I'm sure Ms. Rousso is going to get more heat from the Lake County SA than she would otherwise. This is a piece of public interest now, and an example is going to be made.
Also, white male HP resident here... Didn't get a DUI because I wasn't drunk, but I had to do the whole song and dance for HPPD. They definitely did not provide me with any preferential treatment. In fact, they brought out 3 squad cars and gave me a BS speeding ticket even though they wasted my time and scared the crap out of me with the field sobriety test.
P.S. - can anyone else balance on 1 foot with their other foot extended forward about a foot off the ground while counting 1 thousand 1, 1 thousand 2..... up to 1 thousand 30?!?! Whether sober or drunk??? I should have gone into gymnastics, oh well.

Thats all fine and dandy, I have worked hand in hand for all of the court houses in Illinois have sat in, in a bunch of homicide and dui trials....look at the police blotters they ll have James king and Jose Sanchez getting charged with a simple DUI..YET THERE WAS A 5 yr old girl that died and it wasnt till I spoke to the chief and they knew that a walk was going to happen in HP WAS WHEN THE NAME WAS RELEASED! I know the records are public record. I am saying that the police do not have to release the names for any case. I don't remember the police saying that it was confidential....in that case they were wrong to say that as the records are public. I am aware of the police blotters in all of the papers. All I was saying is that legally the police are under no obligation for release names. If the papers want to find out names and publish the info than so be it. I am also aware that published names are innocent until proven guilty. Maybe some people who comment here should remember that. As far as this community goes, Carly has already been tried, convicted and sent away. I think everyone needs to relax and let the judicial system handle this case. She needs to be punished for her actions. And she certainly shouldn't be getting special treatment. As for her name being removed from the Highland park Patch, could that have been because Patch didn't want to publish anything that hadn't been 100% confirmed?

My husband got a dui 7 yrs ago in Gurnee was.arrested, and his name was on the police blotter the next day....
Sandra Vasquez oswego il charged with 5 counts of reckless homicide while still in the hospital recovering from injuries, 2 days after the accident.
Two juveniles from Waukegan in 2007 took there moms car, hit a utility pole on Washington st. Killing one of the boys in the car and there names were released to the public the next day ...

HP is probably the single most progressive community on the north shore. There was never any question as to whether the driver (who is latina herself) was going to get away with her crime. If every family in HP with a 7 figure net worth could prevent their kids from getting in trouble with the police, there'd be half as many marijuana and alcohol infractions in the blotter. Much less vehicular manslaughter!
Further, the mayor knows the Rousso parents because she is the mayor of HP and the Roussos run the HP Art Center, where they have been praised for successfully turning the finances around and operating many classes that are available to the public.
In fact, if anything I will be voting AGAINST Rotering in the next election because it looks like she threw the Roussos under the bus to score cheap political points! She knew full well that they were pillars of the community and not at all a flight risk and she had to have known that Carly Rousso had been charged with the DUI the day of the accident, regardless of whether it had been reported in the media.

Your point of attack on Mayor Rotering supposedly knowing that the Roussos are not a flight risk from her personal knowledge of them makes no sense.
The parents are not a flight risk because they are not being prosecuted, and have nothing to flee from.
No one can say that Carly is not a flight risk, because she is unpredictable. (The just-posted $50,000 bond, requiring only $5,000 cash, is probably not a deterrent to anything she might do.) Certainly, no one could predict she would cross two lanes of traffic, run down a family on the sidewalk, and then try to back out over them. So no one can predict she won't try to flee the jurisdiction even on bond. I think Mayor Rotering recognized that she could not wear both a mayor hat and a friend hat in this situation, and chose the City.

This "lawyer" has no credibility to post on this forum or has ties to this community whatsoever. He's not licensed in Illinois and is a "blogger" for FindLaw according to his LinkedIn profile http://www.linkedin.com/in/williampeacockesq This "repost" was from some Chicago DUI web site probably just so those people searching for DUI lawyers or DUI crimes can get higher rankings in Google.
Regardless, I do have a question for any Illinois-licensed lawyer out there: Had she refused the Blood test under her 5th amendment privilege against self-incrimination, she would only be looking at an automatic 6-month suspension, right? I'm curious if they could have forced that test on her or not regardless. I was hit by a drunk driver 3 years ago and she refused a breathalyzer and received a automatic 6-month suspension of her drivers license.
In the other article about the Skokie driver. She admitted to smoking marijuana hours before. We do not know if that is the case with Carley as the police and State's Atty have been dead silent on many details.

Thanks, TJ. Unbelievable, recognizance bond for running down a family while under the influence. $50K bond is a step in the right direction. If it's upgraded to felony charge the Judge should make it a Mil so the Roussos have to pledge their house and Carly doesn't flee looking down the barrel of a 14 year jail sentence. I say "should," but he probably won't, because the family will report what a good girl she has been, staying out of the liquor cabinet and doing her CLC homework.

I agree with Joey in that Carly must surely be suffering more than any of us can possibly imagine. The loss she created is inexcusable but so is all the vindictiveness that's directed towards her and her family. I'm sure they're very good people who've had a lot on their hands - as most of us with teenagersd do.

once again, i pray for the family of that little girl. I really do. But carly is a good person, and didnt intentionally hurt anyone. I guess most of you want to take carlys life, the psychological damage, jail, her face everywhere, the hate, and for all anyone knows she doesnt even remember crashing! So much hate.

"Intentionally" killing someone would lead to First Degree or Second Degree murder charges. However, when someone takes the life of another person as a result of their reckless actions - that would be called manslaughter. She should be charged with DUI manslaughter. No one cares about your friendship and your biased opinion about her. There are laws and she broke so many that day, which led to the most definitive impact you can have on another person...killing them. So Joey, this is not about having hate for her. This is about THE LAW. An adult broke the law and ended another person's life because of her reckless behavior that went on for years and her disregard for human life.

really, a good person? she's been drinking and doing drugs since she was 12. she clearly lacks common sense and intelligence and the fact that she chose to drive while under the influence of some drug(s) clearly displays what an awful and selfish person she is. the fact that she doesn't remember crashing further proves how selfish this girl was because she was so intoxicated that she doesn't remember what happened. was that supposed to be comforting to readers? because that makes me hate carly even more for what she did. she killed an innocent child and forever devastated this young family. there's a reason people hate carly....it's because she made careless and selfish choices and because she's a bad person

This should not be about race. This should be about equal rights. The people we hire to protect our streets govern our towns should be doing their jobs without self-interest. If we don't stop corruption in our justice system we will just end up like most third world countries. I believe at 18 year's old your fully aware of the dangers, consequences and the risks of your actions. Teenagers do make stupid mistakes but as patents

I agree that this has turned in to yet another race war yet I disagree so far as your comment about the parents. While I'm sure they were well aware of whatever problems Carly has, they only have so much control as they can't be with her ALL the time. In all seriousness, all it takes is our child making a horrific mistake such as Carly's (or something similiar) and we're in the same boat as her parents.

Wait until the tox results come back before saying "she was stoned" - someone brought up that she suffered from epilepsy, and if that's the case then if she had a seizure it can adversely affect memory.
If she was intoxicated - by all means, prosecute her. If she wasn't, then we need to figure out what went wrong and go from there.

To the man? whom identifies him/herself as Joe. I served at MCB Camp Lejeune for one year. I was in charge of fifteen Marines, as an MP, at the Main Gate. I know you were never there because only respectful, intelligent, and loyal Marines passed through MY gate.
I went through Scout Sniper School in Camp Pendleton.
I was wounded three times. Awarded three Purple Hearts and two Bronze Stars, with Combat V's.
Do I detect envy in your post? Sounds like it. Are you a "wanna be" Marine or Marine Sniper? Or just a "wanna be" Anything?

The actions of an 18-year old adult killed an innocent child and traumatized a family for life. At the least, she should be charged with involuntary man slaughter -- especially considering her illegal underage drinking (and/or huffing) and driving. SHE ALSO TRIED TO FLEE THE SCENE - I spoke to one of the eye witnesses. One of the eye witnesses had to tackle, and pin her down to the ground. Her family's socio-economic status should have no bearing on the consequences received for such a crime - which undoubtedly led to this 18 year old's minimal charges. Look at her tweet describing her pride in her drunk driving abilities when she was 16 years old... Her behavior has clearly been reckless for years and has a complete disregard for other people's lives. Carly may think she's invincible, but a 5 year old walking down the street is not. The court and the public must demonstrate to this girl that she is not invincible to the law.

* The ramblings of a bored teenager listening to a lecture on drunk driving in class.
* A traffic safety student who put on the 'drunk goggles' and happened to do really well at the video game simulation of drunk driving
* Something more nefarious...

While you may not agree with Marine Sniper's comments, I take offense to “Uncle Sam's Misguided Children”. I would hope that you would have some respect for the men and women who served to give us all the right to publicly debate and disagree.
Just the other morning as we pulled over to let an Ambulance pass my 4 year old said. "Dad, ambulance men help us when we are hurt, firemen come if your house is on fire, policemen take away bad people and soldiers help our country." Frankly, I was surprised about her comment on soldiers as I did not think she was really aware of them but we can all learn from children.
I also showed her the flowers at the scene of this horrific tragedy and told her a little girl got hurt there. She said "maybe she forgot to look both ways, I hope the ambulance man took her to get better." I admit to teary eyes at that moment as Jaclyn was about the same age and likely could have had the same thoughts in a similar situation.

Justice was served when they changed the charges. However, she bonded out immediately. This girl will NEVER learn a lesson if her parents keep rescuing her. And I don't want to hear that post traumatic stress syndrome 'made her do this.' I had an oven blow up in my face and I'm not going out huffing or driving my car on the sidewalk. If this happened anywhere else but on the North Shore, the person would have been arrested immediately. Sad commentary on life in the fast lane...

Alice, I do not consider it hate. Rather, I look at it as people on this community are standing up and telling people who are addicts, irresponsible, or otherwise fools that they are not welcome here. Further, it's time that parents wake up and realize that when they don't pay attention and/or don't give their children both the love and tough love they need, the consequences are severe. If you want to enable your teens to drink or smoke weed, go ahead and take your chances - but if you get caught, everyone is going to know about it and talk about it for a lot longer than you'll want.

I haven't heard any statements from HER about remorse for this horrific accident. I know that her parents made a statement. Perhaps it's time for her to say something to the effect of "I'm sorry." I am not implying she did this on purpose, but I hope that she understands that her lack of judgment caused a terrible accident to happen. There are a lot of 'victims' in this situation - some are alive and some are not...

No one accused of a felony homicide makes any such statement unless they are found guilty or coping a plea. We may all want to hear from her, but the only time that is likely to happen is at a trial.

you can say what you wish. maybe im not as good as you are with adjectives and adverbs, but im at a university currently studying psychology so i can one day be a physical dependency councilor and help people like carly before these things happen. i want to help our future generations to come with drug problems. carly was physically and psychologically dependent on substance and she was to deep in. I want to prevent this so ive been in school studying my tail off so i can help this cause and maybe save a future family from the same thing reoccurring. Your negativity is really doing jack. My uncle was a proud Marine himself but he does not brag about it he is a proud, modest man. Just because your a marine does not mean your right.
