Lawyers May Move To Dismiss Teen Burglary Case

Judge checks up on Mahoney and Norris during pretrial after charges the Deerfield teen agers invaded a Highland Park home in August.

 

Attorneys for the two Deerfield teens arrested in August for invading a Highland Park home told Judge Daniel Shanes today in Lake County Criminal Court in Waukegan they may seek dismissal of the case.

Josh Norris and Joseph Mahoney, both 18, of Deerfield appeared in court today for a pretrial as their lawyers and Assistant Lake County State’s Attorney Reginald Mathews told Shanes both an agreed resolution was possible as well as a motion to dismiss.

“I may be filing a motion to dismiss,” Robert Gevirtz, the lawyer for Josh Norris, said. Mahoney’s attorney, Chris Cronson, told Shanes he agreed.

Mathews, Cronson and Gevirtz all anticipate some discussion about the case between them before the next pretrial Jan.31. Gevirtz told Shanes the motion to dismiss would be filed by then. The trial date has been moved to March 4 from Jan. 28.

Cronson expressed the most optimism the case could be concluded without a trial. “There is a substantial probability we will resolve this by then,” he told Shanes referring to the March 4 trial date. Mathews expects discussions with Cronson and Gevirtz but gave a more cautious tone.

“They’re not in a position to discuss an offer,” Mathews said before the hearing. “They want an opportunity to review the evidence and sit down with me to discuss mitigating evidence they may have.”

The judge also made a point of asking Mahoney and Norris if they were complying with the terms of their bail. “I told you before these are very serious charges,” Shanes said to Norris. “It’s very important that you do this,” he added admonishing him to comply with the terms of his bond. Gevirtz assured Shanes Norris was doing well in school.

When it was Mahoney’s turn, Shanes repeated his warning and wanted to know how Mahoney’s counseling and treatment programs were going. “I expect you to comply with the treatment program,” Shanes said.

Let these law abiding gun owners go already. These poor children have suffered enough. I mean, all they did was break in to a home and hold people at gunpoint, then proceeded to flee on foot causing a community to lock down and be on high alert until law enforcement captured them. Are you people sick? These are the faces of two innocent boys who have done nothing wrong.

Welcome to the northshore where your kids can do this if our parents can afford the correct attorney to get them off. They act like this was these kids first offense oh that's right we can't look at the juvenile records and lets not forget all the times these adults didn't get caught.

Moe,
Sage advice. Instead of putting these kids in treatment, let's throw them in jail, spend 100k a year on "Rehabilitaing" them at the cost of taxpayer's and then send them back out to be good and productive citizens for the next 50 years. That will teach them and all of us a lesson. Nobody got hurt, and people deserve a second chance. I am sure that you have made no mistakes in your life.

My nephew goes to Deerfield High School and knows both of them. His says Norris was in the wrong place at the wrong time and is not a bad kid. Mahoney on the other hand needs to go to jail - now. He's a scumbag.

They were informed by a friend who was out of town with his parents that they keep a rifle in the house not in a safe. The kid gave them the garage code or something to get in the house. Rule #1 if you have a firearm, lock it in a safe.

If they were buried deep within 26th and California awaiting trial things would be different. The poor souls would have a Public Defender read their file about 5 minutes before their trial and they would plead guilty to once less charge and do time, learn the prison way of life and probably return to prison once paroled. Something tells me these lucky boys will have a plea deal that prevents them from entering the prison system. A South side African American caught with a gun doing a burglary would do time....a lot of time. The family would be devastated and take the bus once a month to visit their boys. I hope these guys learn a lesson and take advantage of their good fortune and that the justice system watches them closely in Illinois...no Spring Break in Cabo.

Thanks for the advice. After hearing that they stole the firearm, I agree with you. They should be thrown in jail. My only question would be, would it take for them to hurt someone for people to be convinced they shouldn't be in society? If we can't blame them for their actions, then who can we blame?

So Moe, let me see if I understand you correctly, because I am easily confused. If the hope is to keep society safe by reforming these first time offending 17 year old's so they won't hurt anybody in the future. You can pick either (a) Have a stringent probation with a specific treatment program to get them well. (b)Teach them a lesson and show them right and wrong and throw them in Jail. Let all the habitual criminals teach them how to properly behave.
You think society would be better served by choosing b? Just want to be clear.

To RD, FROM the PATCH IN AUGUST:
According to Wilk, Norris and Mahoney went to a home in the 800 block of North Avenue in Deerfield where they knew the residents, claiming they had left keys there and asked if they could look for them.

“They used a ruse to get into the house,” Wilk said. “They know the family. The gun was taken from the home without the knowledge of the owner.”

At 11:50 a.m. on Aug. 2, Deerfield Police received a call from Highland Park Police Detective Scott Fishman asking for assistance locating Norris. He also asked for help in learning if a gun was missing from a home in the 800 block of North Avenue in Deerfield.

When Deerfield Police were able to talk to the home owner, they were told there was a shotgun in the home and where it could be found. The gun was not there, according to Wilk.

Ok cmann, I'll go with your plan A. My only question now is, who should be held responsible once they hurt someone in the future? And, shouldn't we then extend this "courtesy" to all jr home invaders and not just the ones who are privileged?

Again, Moe, the question you must ask yourself, is will they have a better chance of being good citizens and not hurting anybody in the future if they are held to strict probation and rehab in the outside world or will they behave better after they become bitter and angry and ruined in jail. These kids have a legitimate opportunity to turn there lives around on the outside. Regarding the un=privelaged, I am sure if you did a little research, you would find that first time offenders on the south side, would be given a chance to stay out of jail and adhere to a strict probation and rehab program. The problem is that most of them don't comply, and that is a deeper issue.

That's a good point. Lets say they plead down, get probation and reduction to misdemeanor (s)....in most States they could get a concealed carry permit. In Illinois? That's yet to be determined based upon how the Leglislative process goes. Personally, I don't want them to be able to own a gun of any type. Another example of how the system is broken if it allows a CC for these fellows.

These guys are the criminal type that don't abide by gun laws. FOID cards are given to Illinois residents who fit a certain criteria. One being, never convicted of a felony. Don't convict them, they are eligible to own a long gun(which is the one they used in the home invasion) or a handgun when they turn 21. Convict them, legally we keep guns out of their hands until they steal another from a irresponsible gun owner.

Why not position crimes in this country towards use of a gun. For instance, regardless of the particular law that convicts a criminal, use of a gun in doing so should add another 25 years to the sentence (without half time or parole). Practical proposals are needed rather than the "we should have Peace on earth" type solutions.

I only know one of these kids, and I can assure you that he does not come from a wealthy family. Not every kid in Deerfield is a spoiled brat. This is a family with a modest income and home, and I certainly don't blame them for doing everything to help their son. Rehab and counseling will serve these kids and society better than putting them in jail.

Cmann, you win brother. Let these kids go. Your kinda funny though how you defend potential felons. Maybe that's your job, maybe your connected with the families or the case. It will be sad though if the judge gives these guys less then the 6 year "mandatory" Illinois sentence without probation for any class X felony. I grew up here. I get it. Wink wink. The north shore-Lawyers, guns, and money.

Good luck with your case. Clients like me are hard to come by cause I never committed home invasion. These boys Sure are lucky that they will probably get what your fighting for them, and fortunate they don't get what they deserve. Happy Holidays!

Norris is a good kid, I dont know why anyone would say otherwise. Although Mahoney sucks, and is a scum bag, he made a mistake and doesn't deserve jail time. He may act tough but isn't really a tough kid. Norris for sure should not face any time, as for Mahoney, id say a year at most.
