Carly Russo's Lawyers Question Constitutionality of Charge

It's been nearly a year since the Labor Day 2012 accident that left a 5-year-old girl dead.

Lawyers for Carly Russo, the Highland Park teenager accused of running over and killing a 5-year-old girl while high on inhalants, may challenge the constitutionality of the statute under which she was charged, according to an article in the Lake County News-Sun.

It's been nearly a year since the Labor Day accident on Central Avenue that left Jaclyn Santos-Sacramento dead. She was walking with her family on the sidewalk when a car driven by an intoxicated Russo, now 19, ran her over, according to prosecutors. She has pleaded not guilty to charges of reckless homicide and aggravated driving under the influence.

According to the News-Sun article, Russo's lawyers have indicated that they plan to file a motion questioning the constitutionality of the statute under which she was charged.
