Rousso’s Lawyer Files Motion to Dismiss

The DUI case could head to the Illinois Supreme Court.

Carly Rousso’s defense attorney filed a motion this week to dismiss the case against the 19-year-old who was found guilty last month of four courts of aggravated driving under the influence, the Daily Herald reports.

Rousso drove her car across four lanes of Central Avenue in Highland Park in September 2012, killing 5-year-old Jaclyn Santos-Sacramento, who was walking on the sidewalk with her family. Rousso had been huffing a cleaning product, causing her to be intoxicated while driving.

Her attorney, Douglas Zeit, has long argued that Rousso was incorrectly charged because the chemical in the cleaning product is not listed as a legal intoxicant in Illinois.

His motion to dismiss rests on the same argument and says the charges were unconstitutional, the Herald reports. If the judge grants Zeit’s motion at a July 3 hearing, the case will go to the Illinois Supreme Court.

Rousso pleaded guilty to one count of reckless homicide.
