Fresh Thyme Neighbors Sue Deerfield

Two neighbors of proposed grocery store seek review of Village's decision to allow Fresh Thyme Farmers Market to open shop in town.

Two neighbors of the proposed Fresh Thyme Farmers Market grocery store at Cadwell Corners sued the Village, Mayor Harriet Rosenthal and all six members of the Village Board of Trustees Nov. 12 asking the Lake County Circuit Court to take a look at the project.

Deer Run Homeowners Association President Jeff Bizar and Michael Berliant, who have actively opposed the project through the approval process, filed their complaint seeking unspecific administrative review, according to the Lake County Court Clerk’s website.

Another area homeowner, John Sheldon, is the attorney of record for Bizar and Berliant, according to the court clerk’s website.

The Board gave final approval to Fresh Thyme’s request for s special use permit Nov. 4 by a 6-0 vote. Bizar and Berliant filed their suit eight days later. The complaint alleges the Board’s action was “not in accordance with the law” and asks for a court review. It does not specifically say how the Village’s action was illegal and does not spell out what it wants the court to do.

During the process, Bizar, Berliant and Sheldon fought the proposal and the Village responded by making concessions to allay their concerns, some of which Village Manager Kent Street called unprecedented.
